n agreement made before marriage usually to resolve issues of support and property division if the marriage ends in divorce or by thee death of a spouse. Black’s Law Dictionary 1301 (9th ed. 2009).

Premarital agreements (also called prenuptial agreements or “prenups”) are a common legal step taken before marriage. A prenup establishes the property and financial rights of each spouse in the event of a divorce. If you or your potential spouse have significant assets or debts, it may be prudent to at least consider a prenuptial agreement. Prenups are often used to protect the assets of wealthy spouses but can also serve other important functions, such as protecting family businesses.
